1. Acceptance of Terms

By accessing or using the Elite Singles platform, including our website at elite-singles.app, mobile applications, and all related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

Elite Singles ("we," "us," or "our") reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after any modifications constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Eligibility

To use the Service, you must be at least 18 years of age and capable of forming a legally binding contract. By creating an account, you represent and warrant that you meet these eligibility requirements. The Service is intended for individuals seeking meaningful, committed relationships. We reserve the right to refuse service to anyone for any lawful reason.

3. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Membership and Subscriptions

4.1 Free Membership

Elite Singles offers a free Basic membership that allows you to create a profile, complete the personality assessment, and receive partner suggestions. Certain features, including unlimited messaging and viewing full profile photos, require a paid Premium membership.

4.2 Premium Membership

Premium memberships are available through subscription plans with varying durations. Subscription fees are clearly displayed before purchase. All fees are in the currency stated at the time of purchase and are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

4.3 Automatic Renewal

Premium subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You may cancel auto-renewal at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5. User Conduct

You agree to use the Service in a manner consistent with all applicable laws and regulations. Specifically, you agree not to:

  • Post false, misleading, or fraudulent information on your profile
  • Harass, abuse, stalk, threaten, or intimidate other users
  • Use the Service for any commercial purpose, including solicitation or advertising
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Upload viruses, malware, or any other malicious code
  • Collect or harvest information about other users without their consent
  • Use automated scripts, bots, or scraping tools to access the Service
  • Post content that is obscene, defamatory, or otherwise objectionable

6. Content and Intellectual Property

6.1 User Content

By posting content on the Service, including photos, messages, and profile information ("User Content"), you grant Elite Singles a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service. You represent that you have all necessary rights to grant this license.

6.2 Our Intellectual Property

The Service, including its design, code, algorithms, logos, trademarks, and all associated intellectual property, is owned by Elite Singles and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination, including intellectual property rights, disclaimers, and limitations of liability, will survive.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ELITE SINGLES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will result in successful matches, relationships, or any specific outcome. We do not conduct criminal background checks on users and make no representations regarding the conduct, character, or compatibility of any user.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELITE SINGLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you have paid to Elite Singles in the twelve months preceding the claim, or one hundred dollars (USD 100), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Elite Singles, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in London, United Kingdom, in accordance with the rules of the London Court of International Arbitration (LCIA). You waive any right to participate in a class action lawsuit or class-wide arbitration.
